Terms and Conditions for Waste Clearance Soho Services

These Terms and Conditions set out the basis on which Waste Clearance Soho provides waste clearance and rubbish removal services. By booking any waste collection service with us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, or organisation requesting waste clearance services from Waste Clearance Soho.

Company, we, us, our means Waste Clearance Soho, the provider of the waste collection services.

Services means any waste clearance, rubbish removal, or related services provided by the Company.

Waste means any items, materials, or rubbish that the Customer asks the Company to remove and dispose of, excluding any prohibited items as defined in these Terms and Conditions.

Contract means the agreement between the Customer and the Company for the provision of Services, governed by these Terms and Conditions.

2. Scope of Services

The Company provides domestic and commercial waste clearance and rubbish removal services within its operational service area, including collections from residential properties, offices, shops, and other premises. The precise service description, collection date and time, and estimated prices will be agreed with the Customer at the time of booking.

The Services may include collection of general household waste, bulky items, garden waste, light construction waste, and other non-hazardous materials, subject to capacity, access, and compliance with waste regulations.

The Company reserves the right to refuse the collection of any items that are hazardous, illegal, unsafe to handle, or unsuitable for transportation or disposal under applicable waste regulations and health and safety requirements.

3. Booking Process

3.1 Booking methods

Customers can request Services by contacting the Company via telephone or other communication methods made available. At the time of enquiry, the Customer will be asked to provide details such as the type and volume of waste, the collection address, accessibility information, and preferred collection date and time.

3.2 Estimates and quotations

Any price information given before the collection is an estimate based on the details provided by the Customer. Final prices may vary depending on the actual volume, weight, and type of waste collected, as well as any access or parking issues encountered at the time of service. The Company will endeavour to confirm or update the estimate on arrival, before commencing the clearance.

3.3 Formation of contract

A binding Contract is formed when the Customer confirms a booking and the Company accepts it, either orally, in writing, or by attending the Customer's premises to perform the Services. By confirming a booking, the Customer warrants that they have the authority to enter into the Contract and to allow the Company access to the premises and the waste to be removed.

4. Access, Parking, and Customer Obligations

The Customer must ensure that the Company has safe, adequate, and legal access to the premises at the agreed date and time. This includes providing correct address details, suitable instructions, and any necessary access codes or permissions.

The Customer is responsible for arranging appropriate parking or vehicle access as required for the clearance. Any charges, fines, or penalties arising from inadequate or unlawful parking arrangements caused by incorrect or incomplete information provided by the Customer may be charged to the Customer.

The Customer must ensure that all waste intended for collection is clearly identified, accessible, and not mixed with items the Customer wishes to retain. The Company shall not be liable for removing items that the Customer has not clearly indicated are to be excluded from the clearance.

5. Waste Types and Prohibited Items

The Company collects most types of non-hazardous household and commercial waste. However, certain items cannot be collected or require prior arrangement. Prohibited or restricted items typically include, but are not limited to, asbestos, clinical or medical waste, toxic or corrosive substances, gas cylinders, explosives, oils, fuels, chemicals, large quantities of paint, and any materials classified as hazardous under applicable regulations.

If the Customer presents prohibited or restricted items for collection without prior agreement, the Company may refuse to collect them, apply additional charges, or cancel the Service. The Company will act in accordance with applicable health and safety and waste management legislation when dealing with such items.

6. Pricing and Payment Terms

6.1 Pricing

Prices are generally based on the volume and type of waste collected, the labour required, and any additional factors such as access difficulties, heavy items, or extra time needed. The Company may provide a price estimate in advance and confirm the final price upon arrival and inspection of the waste.

All prices are quoted in pounds sterling and may be subject to applicable taxes. The Company reserves the right to revise its prices at any time; however, confirmed bookings will be honoured at the quoted price unless the actual waste or circumstances differ materially from the details provided by the Customer at the time of booking.

6.2 Payment terms

Payment is due on completion of the Service, unless otherwise agreed in writing. The Customer must pay the Company in full by an accepted payment method, which may include cash, card payment, or bank transfer, subject to availability.

For business Customers with agreed account terms, payment shall be made within the period specified on the invoice. The Company reserves the right to charge interest on overdue sums at the statutory rate, as well as reasonable debt recovery costs where applicable.

7. Cancellations, Rescheduling, and Delays

7.1 Customer cancellations

The Customer may cancel or reschedule a booking by providing reasonable notice to the Company. The Company may apply a cancellation charge if the Customer cancels or significantly changes the booking with less than 24 hours notice before the scheduled collection time, or after the Company has already dispatched a vehicle.

If the Customer fails to provide access to the premises at the agreed time, or fails to attend where attendance is necessary, this may be treated as a same-day cancellation and a call-out charge may be applied.

7.2 Company cancellations and delays

The Company will use reasonable endeavours to attend the Customer's premises at the agreed time. However, the Company cannot guarantee exact arrival times and may be delayed due to traffic, weather, or other factors beyond its reasonable control.

In the event that the Company must cancel or reschedule the Service, it will notify the Customer as soon as reasonably practicable and offer an alternative time. The Company shall not be liable for any losses, costs, or expenses incurred by the Customer as a result of such cancellations or delays, provided that the Company acts with reasonable care and promptness in rescheduling.

8. Performance of Services

The Company will perform the Services with reasonable skill and care, in accordance with these Terms and Conditions and applicable laws and regulations. The Customer acknowledges that certain factors may affect the performance of the Services, such as access limitations, loading restrictions, and waste type.

The Company’s staff will take reasonable care to avoid damage to the Customer's property while carrying out the waste clearance. The Customer is responsible for securing or protecting any vulnerable areas or items that may be at risk during the clearance, including floors, walls, and fixtures.

9. Title, Risk, and Disposal of Waste

Once the Company has loaded waste onto its vehicle, title to and risk in that waste passes to the Company, subject to compliance with applicable regulations. The Company will then manage, transport, and dispose of the waste in accordance with its legal obligations as a waste carrier, including using appropriate licensed facilities where required.

The Customer warrants that they have full authority to transfer the waste to the Company and that the waste does not include prohibited items or materials in breach of these Terms and Conditions. The Customer agrees to indemnify the Company for any loss, damage, or liability arising from a breach of this warranty.

10. Compliance with Waste Regulations

The Company will carry and dispose of waste in accordance with relevant UK waste management legislation, including duties relating to the safe handling, transport, and disposal of waste. The Company will maintain any necessary registrations, licences, or permits required to operate as a waste carrier and will keep appropriate records of waste movements as required by law.

The Customer is also subject to certain legal duties as a holder of waste and must ensure that waste is passed to an authorised carrier. By engaging the Company, the Customer acknowledges and accepts that the Company is engaged as a professional waste clearance provider and that the Customer must provide accurate information about the waste to enable lawful and compliant disposal.

11. Liability and Limitations

11.1 General liability

The Company shall be liable for direct loss or damage to the Customer's property where such loss or damage is caused by the negligence or breach of contract of the Company or its employees while performing the Services, subject to the limitations set out in this clause.

11.2 Exclusions of liability

The Company shall not be liable for:

Any indirect, consequential, or economic loss, including loss of profit, loss of opportunity, or loss of business, arising from or in connection with the Services.

Any loss or damage arising from information or instructions supplied by the Customer that are incomplete, inaccurate, or misleading.

Damage to items or surfaces that were already defective, poorly installed, or inherently fragile, where such damage could not reasonably have been avoided in the proper performance of the Services.

Any loss arising from delays, cancellations, or failure to perform the Services due to events beyond the Company's reasonable control, such as severe weather, traffic incidents, breakdowns, or industrial action.

11.3 Financial cap

Except in respect of death or personal injury caused by the Company’s negligence, fraud, or any other liability that cannot be excluded or limited by law, the Company’s total aggregate liability to the Customer in respect of all claims arising out of or in connection with any Contract shall not exceed the total price paid or payable by the Customer for the Services under that Contract.

12. Complaints and Disputes

If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, ideally within 48 hours of the collection. The Company will investigate all complaints in a fair and timely manner and will seek to resolve any issues through discussion and, where appropriate, remedial action.

If a dispute cannot be resolved directly, the Customer and the Company may consider alternative dispute resolution methods. Nothing in this clause affects the Customer’s legal rights.

13. Data Protection and Privacy

The Company may collect and process personal data relating to the Customer for the purposes of arranging and delivering the Services, handling payments, and maintaining records. The Company will handle such data in accordance with applicable data protection laws and will take reasonable steps to safeguard it against unauthorised access or misuse.

By booking the Services, the Customer consents to the Company using their contact details for the administration of the Contract and to communicate about current or future services, subject to applicable consent requirements. The Customer may request access to or correction of their personal data held by the Company in accordance with their legal rights.

14. Changes to these Terms and Conditions

The Company reserves the right to amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise notified to the Customer and will apply to all Contracts entered into after that date. For existing bookings, the version of the Terms and Conditions in force at the time of booking will normally apply, unless changes are required by law.

15. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by the Company.

By confirming a booking with Waste Clearance Soho, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
